    Thailand on most-watched list of IP offenders

    Washington - The Barack Obama administration on Thursday said it would keep Thailand on a special watch list of what it considers a Dirty Dozen nations that fail to crack down on copyright and patent violations.

    Thailand "has not made sufficient progress' in combatting various kinds of intellectual property rights (IPR) offences, said the annual report of the US Trade Representative.

    "The Thai Government made little progress over the past year in addressing the widespread problems of piracy and counterfeiting."

    Along with Thailand, the USTR named  China, Russia, Algeria, Argentina, Canada, Chile, India, Indonesia, Israel, Pakistan and Venezuela as the world's worst IP offenders.

    The countries made the elite US 301 Priority Watch List, named for the section of the Commerce Act regulating the alleged offences. Canada, Indonesia and Algeria are new additions, while Thailand and the other eight were also on last year's list.

    Once a country is listed under the priority watch list, the PWL becomes a basis for the US to press for a "constructive engagement" with that trading partner. Or, to put it another way, exerting diplomatic pressure to change its IP regime.


    In theory, the 12 countries on the list could be subject to penalties, trade barriers and embargoes. So far, no action has been taken against Thailand.

    In addition to naming Thailand as a top IP offender, the USTR also identified five popular areas in Bangkok as among the world's most "Notorious Markets": Pantip Plaza, Mahboonkrong (MBK) shopping centre, and the Klong Thom, Patpong Road and upper Sukhumvit Road areas.

    The slim section on Thailand in Thursday's US report was a fairly familiar mixture of carrot and stick. For example, while the US is troubled by "a broad range of continuing concerns" about piracy in Thailand, "We welcome the Thai Government€™s message that stronger IPR protection and enforcement is a national priority."

    For the first time, the US report directly addressed the touchiest issue between the two countries - mandatory licensing of drugs. The government has insisted it will not backtrack on its strong stand in favour of removing drug patents for some life-saving drugs in order to reduce prices and increase availability.

    The Obama administration, like the Bush team before it, opposes this. "[We] encourage Thailand to ensure that the patent system promotes the development and creation of new lifesaving drugs," the report says.

    "We  urge Thailand to consider ways of addressing its public health challenges while maintaining a stable patent system that promotes investment, research, and innovation."

          don't ya all agree that Thailand has other problems?

          plus, I do think that "intellectual property" is in most cases questionable: "billabong", "gucci", "armani", "nike", ... all mass consumption products... so nothing of this is really valuable.

          I didn't see any forgeries of Church or Giorgio Armani items ... Lanvin wasn't very copied either... not flashy enough for the gullible and vulgar farang masses?

            Code for maintaining obscene profits for selected drug companies above the needs of the countries they sell into to.

            It's like the other drug trade. Nobody forces you to buy drugs, up to you.

              Government Takes Tough Stand on Pirate Goods

              The current crackdown on intellectual property violations will continue, Prime Minister Abhisit Vejjajiva said on Thursday, echoing the tough stance of Commerce Minister Alongkorn Ponlaboot who vowed earlier in the day to conduct raids on sellers of pirate goods every two days.

              Mr Alongkorn also pledged to make sure ministry officials display identification before commencing arrests and confiscating goods.

              The government's hardening of its stance follows a raid on vendors in Patpong on Wednesday night and a clash which led to 11 people being injured.

              Vendors filed a series of police complaints against commerce officials, accusing them of assault, damaging property and abuse of authority.

              Mr Alongkorn said the public must view Wednesday night€™s incident fairly as officials on the raid also suffered serious injuries.

              Mr Abhisit said he would be going over reports of the incident to determine if officials acted inappropriately, which might prompt a revision of raid procedure.

              Venders clashed violently with ministry officials in Bangkok€™s tourist centre of Patpong. There were reports of gunshots being fired into the air to scare off the officials.

              About 200 vendors and 50 commerce officials were involved in the conflict, which erupted after officials raided sellers€™ booths to arrest them for intellectual property violations and confiscated their goods.

              Officials arrested four sellers and made off with four vans loaded with confiscated counterfeit goods, mostly pirate copies of bags and clothes.

              The arrested vendors were taken to Bang Rak police station. They were given bail on Thursday morning. Another vendor under charge was being treated for his wounds at hospital.

              Other vendors shortly afterwards marched to Bang Rak police station to file charges against the commerce officials. They accused them of assault and causing damage to property.

              Some sellers, covered in blood smears, told reporters they were assaulted by the raiding party. Market vendors continued to file charges with police throughout Thursday.

              National police chief Gen Patcharawat Wongsuwan said he instructed the chief of Bangkok police to closely supervise all issues relating to the incident.

              Pol Gen Patcharawat said he would examine reports that Central Investigation Bureau police took part in the raid.

                  agree stogie perhaps if they got those "pikies ?" off the patpong streets it would do away with the hoards of white trash searching for a "bargain watch" and allow the true bargain hunters and men of valour such as ourselves unhindered access to the fair maidens that abound in the area. the farang masses puts many guys off for sure as we all know.............i say banish the the shite markets!

                        ive said my prayers allready,ive even asked a friend whos a christian to email the lord a map of patpong so he knows the spot in question,im not holding my breath for a response tho...........still if you dont ask..............

                          Add TUK COM Pattaya to the list of pirated goods sellers!  

                          Bought a 'Kingston' 16GB memory stick, from a store on 2nd floor - turns out to be a fake.  Confirmed by Kingston, when I queried why it didn't have the password protection it promised on the packaging.  Always get the warranty sticker from the seller - mind you, that might be fake too.  TIT  

                          Went back today for refund.  Yes you know the outcome!  At least it has 16GB of memory - but isn't a Kingston and the download speed is poor.

                          It seems that ALL the Kingston memory sticks at J&J Accessories are counterfeit, as they are all marked 'password protected' (when Kingston say they stopped selling Data Travellers in that format in January).

                          I may try Pantip Plaza next week
