  • Getting Married to an LB in European Union

    Guys and Dolls

I have lately been involved in the procedure of getting married with an LB in an European Union country where the Gay marriages are allowed (although I am not gay, I am forced to do so since my LB GF still has a male ID ) , I create this guide/thread for the benefit of the ones who have not yet decided and/or still thinking about it.

European Union has voted, allowed and enforced the gay marriage laws to all European Countries but not all of them still allow them. All of them should accept the EU normative within the next 3 to 6 years but depending on the governments (right or left wing, etc) will vote them or not during their governing time. For example, Italy, where someone can find the biggest trans lover population as well as the best looking transsexuals of Europe (subject to discussions) will not allow gay marriages for at least another 5 to 6 years due to the Catholic Church. On the contrary, a very Catholic country like Spain allows them for the last 2 years and just 2 weeks ago allowed LBs to change on their IDs their sex even without going through SEX CHANGE OPERATION (Spain is years ahead regarding human rights compared to many more wealthy EU countries...). I think Thailand, the country with the biggest LB population on Earth, should follow Spain's example in this aspect... anyway.

I have mentioned above about Gay Marriages because I assume that you THAI GF has not yet changed her identification Document even if she has successfully undergone sex change operation. So, here are the documents and procedures you need to fulfill.

    Documents:

    1) Official Birth Certificate (both place and date of birth should be there)
    2) Official criminal record (less than 3 month old). It may sound funny, but all European countries would like to know if you are getting married to a serial killer
    3) Sign a piece of document (testifying) that states you are not married and if so bring the documentation that testifies you have been successfully divorced (and not yet in courts, etc.)
    4) Sign together in the presence of a witness a piece of document (usually takes place in site) that says that both you would like to get married (sound stupid I know)
    5) Photocopies of valid passports and real passports (witness both during the first meeting and later on should also carry their ID)
    6) Sometimes depending on the EU country you may need to provide a document that states that your LB gf is allowed to get married in this particular EU country. Strange...

    Procedures:

    1) All documents (for the Thai LBs and you) should be less than 3 months old and translated to the official language of the country you are going to get marry
    2) Your future wife (lb) , you and your friend (as witness) appear at the site and sign the piece of paper in the presence of the public administrator that says you would like to marry
    3) Deliver the rest of the documentation. The documentation will be checked and you will be assigned a number or date and time for getting married. This procedure may take days or months depending on the volume of CIVIL marriages before you. In some countries like the UK is ever restricted to so many numbers per year
    4) Finally, once you have been assigned a date you appear there and you get married (so easy as it sounds). By doing so, you automatically allow your LB wife to get an EU green card within days

I hope that this discussion will be useful to the ones who would like to get married to an LB now or in the future.

Please fell free to add your comments and/or new information regarding marriages in EU, US etc.

      btw
you can marry in Canada with less documents and no need to be resident, i think if you want to marry in EU you need to be a citizen there at least one of you.

        In general this is correct

Only for the Netherlands I know you NOT get an automatic green card. Married or not is of no importance
Your "wife" will have to go through to the whole inburgeringsprocedure and even then ?

Holland an open country: forget it

In near future Germany will use the same rules

You have to bring the same documents even for a gg as for a lb...there was no difference...you have to sign a partnership contract...and the partner get a 6 month visa....till you divorced...after around 5 years she or he could request for a German citizenship....the same was in Belgium and France...
What documents you need exactly, could be from area to area a little different...
          But one is clear...no job,no money...no chance....

In Switzerland you need the same papers. But you must legalise the document on the Thai-Consulate in Swiss. You must also prove that you know eachother at least for one year ( Photos, e-mail, tel. bill).
They can also prove your financial situation, if you can take care your new "wife"

Fot the first 5 years you get the "B" Residency[with this one she could work already]. After this 5 years you get "C" Residency, whit this one you can request for the swiss Passport (need another two years)

Diablo, i'm very interested by your account of marrying a LB in the EU. I am a UK TS and I have a Filippino boyfriend who is currently here in the UK on a student visa. He will have to leave at the end of year 2 and I simply don't know what to do then.
Are you saying that a civil marriage in the EU (in particular the UK) gives your foreign  partner citizenship? Does that mean that he will be able to get a UK passport?
I guess what I'm asking is does 'marrying' your LB give her the right to remain in the UK?
Thanks so much for a great posting.

if your bf has 2 years left on his student visa, start gathering evedence of your relationship now..photos, utility bills, council tax bills etc.

if you can prove you have been in the UK and in a relationship with you he can get a resident visa as your un-married visa.

i am in a relationship with a thai ladyboy, we are not married, but she has a resdent visa as my 'same sex' unmarried partner

                good luck!

If you went through a UK civil partnership marriage partnership with your boyfriend he would have to be resident in England for a further 3 years before applying for a UK passport.

However, following your civil partnership he could apply to the Home Office to get his visa status changed.

Suggest that you speak to a solicitor who specialises in visa applications
