Well if what they say is true she would not require a bar fine as she is not in a bar.
She is standing in walking street she should be fine free.

Chances are she is just strolling down walking street to or from a bar.

It's not easy for a foreigner to spot an lb on appearance alone, but most Thais are able to.

As you've already stated, the implants are one sign - although more Thai ggs are also getting this done. The next would be the feet and hands. If a Thai lb started taking hormones later in puberty or afterwards, her hands and feet will be larger than that of an average gg. Also if you take a look she most likely has had a nose job, quite common for Thai lbs. If you met her in person, the voice would also be a good indicator. Most Thai lbs have a deeper voice than a gg, or speak in a falsetto, which is easy to spot. Lbs are also generally taller than the average Thai gg, unless they started on hormones before or very early on during puberty. A couple of other clues, lbs tend to look at themselves in the mirror much more than ggs - as they feel insecure about their beauty/passability, and they also tend to play with their hair more than ggs.

She is a freelancer, not based in any particular bar. Currently Thai authorities in Pattaya have been pursuing the "clean up" to go farther than Phuket in hopes of avoiding having the military do it for them, as was the case in Phuket. I also think that certain investors in the real estate sector want a clean up of the bars and sex clubs on Walking Street to redevelop into more "family" based properties.

Freelancers tend to work around Hot Tuna Bar, which is around the area opposite the Simon Bar complex on Walking Street (long ago the former Simon Cabaret).

Tallness for sure is one of the big ones. Thai's don't tend to have big adams apples so that is usually not a factor like in America.
Also they tend to have less body fat and thinner faces. Thai women will often have fat rosy cheeks.
Women will often have flatter noses than ladyboys, as well.

This girl to me looks like she is just walking down the middle of walking street, not necessarily working there at that time.
I assumed since they weren't throwing her in the Paddy wagon with the others that she was just nearby.
Usually the street freelancers aren't this good looking, or she could even just be a plant for the article.

This question was also posed by the "Sisters" group in Pattaya. The response was that the police are cracking down on all freelancers, and lbs just happen to be the biggest group.

Not a good explanation, as we don't see many reports of them arresting the gg freelancers. The other comment not officially made is that they feel lbs freelancers commit more crimes against tourists.

They assume all loose ladyboys on walking street are working.
Whereas girls could just be girls enjoying walking street.

In Canada Ladyboys get banned from hotels a lot because it is always assumed they are working. 93% of the time the hotels are right.

Also Ladyboys make good scapegoats. Many tourists are actually afraid of them, not for any particular reason other than they probably don't understand them or have never seen any before. Many of the cultures represented there tend to look down on LBs so it is not hard to blame them for the bad stuff.
