    It just got a little easier for a transgender person to work at American Eagle Outfitters - at least on paper.

    Attorney General Andrew Cuomo has forced the flannel and khaki outpost to make some changes, including nixing a rule about employee "personal appearance" that banned men from wearing women's clothing and ladies from dressing as guys.

    "This shows me that there's faith and hope. There might be a domino effect, that's what I'm hoping for," said Joi-elle White, 35, a transgender member of Make the Road New York.

    The community group complained to Cuomo's office about what it called a pattern of discrimination against transgender job hunters. A probe confirmed the complaints, officials said.

    The retailer - which employs more than 2,000 people in its 61 New York stores - signed a settlement deal promising to change its policies and employee handbook.

    "To avoid further expense and the distraction of a prolonged argument, [we have] agreed to a compromise settlement in this case, with the understanding that AEO is not admitting to the findings," a company spokeswoman said.

    "We wholeheartedly believe that transgender individuals should be treated equally," she added in a statement.

    The chain store also has agreed to train its staff on transgender issues - like which pronouns to use when referring to workers and customers.

    The April settlement is the first crackdown against a retailer under the section of the state's Human Rights Law that bars employers from discriminating against applicants because of their gender identity.

    "If more places would follow behind American Eagle's experience, a lot of us would be able to work more. and there would be less of us on the street or on the Internet risking our life just to survive," White said.

    If other clothing stores offered transgender people jobs, it would get them off of the streets and the internet risking their lives? Is this person suggesting that if you can't work in retail you have to turn tricks? There are millions of ways to start a business on the internet (without even needing a business loan), and fast food places can't pay that much less than retail. This article is all well and good for NYC, but good luck to them if they want to represent a corporation like that 20 miles outside of the city where people would be more likely to boycott AE over a transgender sales associate then they would Arizona over its immigration laws. The business model behing retail sales is that the employees are supposed to represent what the kids WANT to look like - not what the sales associates want to look like. Hence you are required to wear AE clothes if you work there, even if your individual style is completely different.

    AE should be able to hire whomever they want, they should not be mandated to make changes. It's their company - let them run their company as they see fit. Out of all the things going on in the world, this is the one issue they want to concentrate on? Ridiculous!

    Easy... AEO re-defines "employees" as "character actors portraying actual employees", then their clothing becomes a "costume" and AEO can dress them however they dang well please.

    Pete from LI - your ignorance amazes me. If you read the entire article you would gather that transgender people work in all types of jobs including at American Eagle. Since they are a major corporation they have to follow guidelines and cannot force people to dress a certain way and openly discriminate. Similar to the Gap, Old Navy, Express, Etc. If you can't handle seeing transgender people don't leave your house and certainly stay out of the subway they may bite.

    So Heather, you are saying a private corporation is prohibited from having a dress code ? Do you normally smoke weed at 9 am ? What if the transgender men decide to show up in a bikini top,thong and sandals, does the Corporation get to send them home, or do they have to sit helplessly and watch as thousands of customers leave their establishment in disgust ? You are truly astounding heather, you have been blinded by Political correctness,and are sadly unable to see that an employer has the right to mandate a dress code for the employees.     Will there be HIS, Hers and TRANSGENDER bathrooms in the store? I would pay money to see who went into the T/G room! This company is being held up as surely as if Cuomo had a bandana on his face! Accommodation is one thing, what the A/G is proposing is EXTORTION ! pure and simple! He threatened the company with a long discrimination fight that would cost the store chain millions! That my friends is DISCRIMINATION! How many "T/G " are we talking about here , 100, 10,1 ? Just how many "Adam's apples " want a job where they can only wear the flannel and khaki set? I for one will be aware that the salesman measuring my inseam is not there for his sexual gratification! UGH! NOTE: I just did a spell check and the dictionary didn't recognize TRANSGENDER ! Mr, Cuomo, please concern yourself with the fiasco in Albany and leave business alone to figure out what their customers want!

    The schools are next. They removed the laws which made this type of behavior 'abnormal' . This law is now being changed to include 'getting a thrill out of being against porn' as a mental illness. So if you DARE to say that you believe porn is a problem you have very good chance of going to jail. A short forty years ago these transgendered medically unfit people would either be in jail or in an institution IF they displayed this abnormal behavior in public. These people have a medical condition which is accompanied by in most cases by severe psychological damage. The laws are going to be even worse now that they are going to have a JUDGE on the Supreme Court who is 'closeted' . "Why Are People Pretending That Elena Kagen Is Not A Lesbian?"     Just to clarify this issue to some of you being transgendered is about an individual's personal sexual identity and not about their sexual preference. A transgendered person is not "A man dressed as a woman" nor does it mean that they are gay. In laymen's terms, its as if a man was born with a woman's brain (or vice versa). So Pete from LI, MBDono and the rest of you, instead this is not about PC behavior gone mad, or some gay man trying to cop a feel this is about compassion and respect for a fellow human being.

    Pete from LI - where in my comment did you gather that a private company is not allowed to have a dress code? Almost all companies have a dress code that should be held at a "reasonable" level. If a transgender man came to work in a bikini undoubtably would be asked to go home and come back in reasonable attire as would any woman who chose to dress that way. The key word is reasonable, but the examples you come up with would never happen, have never happened and is by far a stretch of the imagination. People who are given any position at any company are judged based upon qualifications, not age, race, appearance, sexual preference, etc. If their appearance bothers you then trying looking 1/2 inch deeper into what people really are about not just their physicality.

The difference, however is based on our interpretation of the Constitution, and where we want this country to go in the future... There are those who see conservatism's approach as somewhat backwards and less then inclusive when viewed from the left.. Just as there are those who see Liberalism as dangerous and immoral when viewed from the right... That's a fair assessment, don't you think?...Whoever wins the White house get to put forth THEIR agenda, and sign into existence laws, as well as pursue legislation that THEY see as needful..     Giving someone the right to vote can not be compared to this issue. Race and sex are not choices. Dressing like a freak is. Any employer should have the right to hire people that enhance his business, and not be forced to hire people that will cause a distraction by their presence. Anyone who feels so strongly about trans gender rights should start their own business and hire only transgenders. See how long you stay in business.

    Toy -- I agree 100% with your comments to me. We feel differently and passionately on issues but must respectfully agree to disagree. For me personally, I have seen our society change drastically since the 1950's with social issues and technology. It's diffcult at times to deal with it.

    Seems like there's always a dude on TV (or Daily News Threads), doesn't it? You know, the anti-gay activist who is secretly involved in an apparent pro-gay activity? Last week, it was discovered the Family Research Council's George Rekers recently hired a gay male escort to carry his luggage around Europe. The escort says Rekers wanted him to give him erotic massages. (Rekers denies he is gay). But Rekers' story is very similar to that of pastor Ted Haggard, whose story was like Sen. Mark Foley's, whose story was like Gov. Jim McGreevy's, whose story was like ... well, you get the picture. It's as if being anti-gay is the new coming out.

    filanka-... Yes, it IS difficult at times to deal with change.. but that is the nature of life... Nothing EVER stays the same.. A womens right to choose her own reproductive future is really a new, yet hotly contentious issue... Some on the right feel strongly about folks NOT having a choice, ye by law, that choice exists... Slavery being abolished wasn't the end of the issue.. it was followed by "jim Crow" laws.. which, while many have been repealed, the sentiment behind their creation is STILL very much in evidence... Now we get to the point of gender issues.. Freedom, after all is meant for all...Not a terribly complicated concept.. now is it?

    filanka-... You have a good day as well...BTW, the bathroom issue is not an issue at all... It's really rather simple.. IF a person is POST-OP they go the bathroom suitable for their biological characteristics.. (Male to female transexual that has had the operation).. since they are LEGALLY female... The same applies to folks such as Chazz Bono.. HE would go the MENS room since he is LEGALLY male..... PRE-op transgenders go to the rest room appropriate to THEIR status... You see that as a problem?.. It isn't.. The law is the law.

        Well, I agree that employers should be able to turn down applications from persons which are visibly or audibly transgender for jobs in which they would have contact with customers (no problem for admin or warehouse jobs).

          In the fashion industry more than most others the 'image' is what sells the product.

          I believe that this business should be able to decide for themselves who 'fits' their corporate plan and who doesn't.

          This isn't an advancement for the transgendered movement - just another step back for private enterprise.
